The way I do palettes is when I see something I like - OFF the ColourLOVERS site - and get it into Photoshop. I choose five separate colors or, make a gradient of the lightest and darkest in one range then Index Mode it to five colors. If the colors are already here - fine. If not I name them. I don't care either way, but I won't play, or be drawn into, any games over this.
